FIVE STARS Bed&Breakfast REGULATIONS

§1 Introduction

  1. The administrator and owner of the FIVE STARS Bed&Breakfast facility is the company PHU DEAL, located in Kiełczów, postal code 55-093; ul. Północna 1; NIP: 911 133 60 50; registered in the Central Register and Information on Economic Activity of the Republic of Poland.
  2. The FIVE STARS B&B facility provides accommodation, gastronomic, and other services in accordance with its business profile.

§2 General Provisions

  1. The Regulations define the rules for providing services and using the infrastructure at the FIVE STARS Bed&Breakfast facility, making reservations, canceling reservations, methods and terms of payment for services, accommodation rules, and liability.
  2. The Regulations are an integral part of the agreement, which is concluded by making a reservation, paying a deposit or the entire fee for the stay at the FIVE STARS Bed&Breakfast. The execution of the Agreement takes place on the terms specified in the Regulations.
  3. By performing the above actions, the Guest confirms that they have previously read and unconditionally accept all the terms of the Regulations.
  4. For Agreements concluded outside the premises, the provisions of Article 38 para. 12 of the Consumer Rights Act (Journal of Laws of 2014, item 827) apply.
  5. A description of rooms, sample photos, price list for accommodation services, and other services can be found on the website www.fivestarsbb.com and at the Reception.
  6. The Regulations apply to all persons staying at the FIVE STARS Bed&Breakfast.
  7. The Regulations are available on the website FIVE STARS Bed&Breakfast at the address: www.fivestarsbb.com and for inspection at the Reception.

§3 Reservation and Cancellation Conditions

  1. Reservations for stays at the FIVE STARS Bed&Breakfast can be made: by phone, by email, using the address provided on the website, through the Reservation System available on the website, directly at the Reception, or through Booking Portals that cooperate with the facility.
  2. The Guest is solely responsible for the consequences of providing incorrect data during the reservation process.
  3. Telephone reservations can be made by contacting the Reception of FIVE STARS Bed&Breakfast at tel. +48 881 339 339 and providing the necessary data and information required to create a reservation in the Reception System.
  4. Making a reservation through the Reservation System available on the www.fivestarsbb.com website is possible by selecting the “Book” option and involves choosing the date, stay offer, and filling out the reservation form. The System will calculate the price for the stay according to the applicable Price List. The reservation will be created after pressing the “Book” button, which will be available after accepting this Regulation.
  5. After making a reservation through the Reservation System, the Guest will receive a confirmation to the email address provided during the reservation process.
  6. After making a reservation by e-mail, the Guest will receive a confirmation of the preliminary reservation to the provided e-mail address, which includes the reservation terms and necessary information for making a prepayment.
  7. Reservations made by phone, through the Reservation System, or by e-mail have the status of pending reservation until the Guest makes the payment.
  8. The amount paid may be equal to the total cost of the stay or less, according to the indication of the Reservation System or the receptionist accepting the reservation. For one-night reservations, the prepayment amount is 100% of the stay value.
  9. The amount paid towards the reservation, which is less than the total cost of the stay, is treated as a prepayment.
  10. If the prepayment is not received in the designated timeframe or is received later, FIVE STARS Bed&Breakfast reserves the right to sell the stay to another person and cancel the reservation. Failure to make the prepayment within the specified period will result in the cancellation of the reservation.
  11. If the Guest cancels the stay at least 24 hours before the start of the reserved arrival date, the prepayment will be refunded to the Guest’s account within 7 days from the date of cancellation by FIVE STARS Bed&Breakfast, or in the form of a Voucher equal to the prepayment made. The redemption of the Voucher at FIVE STARS Bed&Breakfast is possible after prior contact with the facility to agree on the date, room availability, and other stay conditions, as well as the pricing according to the current price list at that time.
  12. Changing the stay date must be agreed with FIVE STARS Bed&Breakfast at least 24 hours before the start of the hotel day and is subject to availability. Changing the stay date results in a new pricing of the stay.
  13. If the Guest does not show up at the facility on the day of arrival or fails to report the cancellation or reports it less than 24 hours before the start of the reserved arrival date, the prepayment will not be refunded.
  14. At the Guest’s request, FIVE STARS Bed&Breakfast will send a confirmation of the prepayment by the Guest after the payment has been credited by the Bank to the facility’s account.
  15. The Guest is obliged to pay the costs of the stay reservation no later than on the day of check-in.
  16. Service prices include VAT at the applicable rate depending on the service provided.
  17. FIVE STARS Bed&Breakfast may collect a deposit from the Guest as a security deposit in the amount of 500 PLN. The deposit must be paid in full before check-in. Failure to pay the required deposit will result in the cancellation of the reservation, regardless of the booking source. The deposit can be paid by bank transfer to the facility’s account or in cash at the reception. The deposit will be refunded within 7 days after the end of the stay to the account from which it was paid or in cash if it was paid at the Reception. FIVE STARS Bed&Breakfast reserves the right to retain the paid deposit in whole or in part in the following cases:
    • a) in case of gross violation of the facility’s regulations, especially in case of disturbing the night quiet or violating the ban on organizing parties and social gatherings in the facility,
    • b) violation of the smoking ban in the facility,
    • c) in case of damages and destruction in the room or loss of its equipment,
    • d) if, as a result of the actions of the person renting the room, it will be necessary to temporarily suspend further renting of this room.
  18. Payment for the stay is non-refundable in case of early departure.
  19. The stay of pets on the premises must be previously reported and confirmed at the Reception.
  20. Additional charges may apply for pet stays at FIVE STARS Bed&Breakfast.

§4 Accommodation

  1. Check-in is possible until 8:00 PM on the day of arrival. In case of later arrival, please inform the Reception by 8:00 PM.
  2. Early check-in is possible after agreeing with the Reception on room availability.
  3. The basis for guest accommodation is the presentation of a photo ID.
  4. Upon check-in, filling out and signing a registration card may be required.
  5. FIVE STARS Bed&Breakfast reserves the right to refuse accommodation if the Guest:
    • a) does not have or refuses to present a photo ID,
    • b) refuses to fill out and sign the registration card,
    • c) refuses to pay for the stay or mandatory fees,
    • d) during their last stay, the Guest grossly violated the facility’s regulations,
    • e) behaves vulgarly towards the staff,
    • f) the Guest is under the significant influence of alcohol or other intoxicating substances, does not adhere to social norms, or causes disturbances.
  6. The Guest does not acquire the claim for the availability of a specific room in the facility.
  7. Upon check-in, the Guest receives a properly programmed key card for the room and for the entrance gate to the facility, or entry codes are sent to the Guest via email or SMS to the contact details provided during the reservation.
  8. Upon request, changing rooms during the stay is possible after agreeing with the Reception on room availability, with no reduction in the payment for the stay and may be subject to an additional charge.
  9. Visiting guests may be present on the premises of FIVE STARS Bed&Breakfast from 7:00 AM to 10:00 PM.
  10. It is prohibited to lend the room to third parties, even if the period for which the fee has been paid has not expired. The room is rented to specific individuals indicated in the reservation.
  11. At the Guest’s request, the facility can provide luggage storage services during the opening hours of the Reception.

§5 Hotel Day

  1. The room is rented on a hotel day basis.
  2. The hotel day lasts from 3:00 PM to 11:00 AM.
  3. If the Guest wishes to extend the hotel day or stay, they should inform the Reception no later than 10:00 AM on the day when the room stay ends.
  4. The possibility of extending the hotel day until 1:00 PM depends on room availability and is subject to an additional charge.
  5. If the Guest does not vacate the room by 11:00 AM and does not inform about the desire to extend the hotel day, it will be automatically extended for another day at the current room rate. In case of inability to extend the hotel day, a fee of 30 PLN per additional hour of stay will be charged per person.
  6. If the Guest does not appear at FIVE STARS Bed&Breakfast by 11:00 AM on the checkout day, the facility reserves the right to enter the room and move the belongings to storage.
  7. FIVE STARS Bed&Breakfast reserves the right to refuse to extend the stay if the Guest has not settled the payment for the previous stay.

§6 Stay Rules

  1. Quiet hours are in effect from 10:00 PM to 7:00 AM. During this time, only registered Guests are allowed in the room. FIVE STARS Bed&Breakfast may refuse to provide further services without refunding the stay costs in case of violation of this rule.
  2. The Reception is open from 8:00 AM to 8:00 PM. Any inconveniences related to the stay should be promptly reported to the receptionists to enable the staff of FIVE STARS Bed&Breakfast to take necessary actions and improve the standard of services provided.
  3. Room cleaning is performed upon the Guest’s request.
  4. Smoking is strictly prohibited in the rooms and on the premises of the facility. Violation of this rule will result in a fine of 500 PLN covering room cleaning, prolonged ventilation, additional laundering, and cleaning of equipment.
  5. If necessary, FIVE STARS Bed&Breakfast may carry out necessary repairs of room equipment in the Guest’s absence.
  6. Throughout the stay at the facility, children must be under constant supervision and control of adults.
  7. Minors up to the age of 13 may use the elevator in the facility only under the supervision of adults.
  8. Upon request, the Guest can be provided with an iron and ironing board free of charge.
  9. Upon request and subject to availability, a cot for small children (up to 3 years old) can be provided in the room free of charge.
  10. For safety and proper room security, the Guest is obliged to close windows, turn off the TV and lights, turn off taps in the bathroom, and lock the door every time they leave the room. If access codes to the room and facility are provided for the duration of the stay, the Guest is responsible for protecting them and not sharing them with others. In case of loss or misplacement of the key card for the room and entrance doors, the Guest must report it immediately to the Reception.
  11. For fire safety reasons, it is forbidden to use electric heaters, irons, etc. in the room.
  12. Dangerous materials such as weapons, ammunition, flammable materials, explosives, or irritants cannot be stored in the room.
  13. Organizing parties and social gatherings in the rooms is strictly prohibited. In case of intervention by the Police, Municipal Guard, or security company protecting FIVE STARS Bed&Breakfast, a fine of 1000 PLN may be imposed on the Guest.
  14. Guests are prohibited from removing from the premises any items that constitute the equipment of FIVE STARS Bed&Breakfast. Some equipment items (e.g., towels, decorative pillows) can be purchased. Information can be obtained at the Reception.
  15. Selected areas of FIVE STARS B&B are monitored.
  16. In case of pets staying on the premises of FIVE STARS Bed&Breakfast, the owner is obliged to keep the animal in such a way that it does not pose a threat to the surroundings and to clean up all waste associated with its stay.
  17. Pets must be kept on a leash in public areas.

§7 Liabillity

  1. The Guest is obligated to leave the room and provided equipment in an undamaged condition.
  2. The Guest is responsible for any damages to the FIVE STARS Bed&Breakfast facility caused by themselves, accompanying persons, or visitors. Damage includes both destruction/damage to room equipment and their loss.
  3. In case of damage or destruction of room equipment or other technical devices on the premises, the Guest is obliged to report the incident to the Reception of FIVE STARS Bed&Breakfast.
  4. The Guest bears direct material responsibility in the event of damages, destruction, or loss of room equipment elements, especially:
    • a) furniture, lighting, and other decorative elements in the room,
    • b) sanitary fixtures, bathroom equipment elements,
    • c) damage to towels, bedding, curtains, drapes, and other textiles in the room resulting from tearing, cutting, use of cosmetics, makeup removal, shoe cleaning, etc.
    • d) bulb replacement, overvoltage with the use of non-certified electrical and technical devices of the facility.
  5. The equipment price list and the damage removal price list are attachments to the Regulations and are available for inspection at the Reception of FIVE STARS Bed&Breakfast. Regardless of the price list, FIVE STARS Bed&Breakfast reserves the right to individually and separately assess damages depending on the work required to remove the damage. The valuation of lost equipment or damages and the costs of their removal will be determined by FIVE STARS Bed&Breakfast after the Guest’s stay at the facility, based on the costs of purchasing materials, equipment, and the cost of repair or replacement services.
  6. The Guest bears direct material responsibility as in point 1 in case of losing the key card to the room or providing it to unregistered persons, resulting in damage or theft by third parties.
  7. The Guest bears full and direct material responsibility for the loss of the room key or access card and parking card. Charges for a lost key or magnetic card are specified in the damage removal price list, which is an attachment to this Regulation.
  8. In case of damages or destruction caused by the Guest, FIVE STARS Bed&Breakfast reserves the right to charge the Guest’s credit card for the damages after their departure.
  9. In case of breach of the Regulations, FIVE STARS Bed&Breakfast reserves the right to immediately cease providing services. The person violating the regulations is obliged to comply with the demands of FIVE STARS Bed&Breakfast, settle the accommodation costs, and pay for the damages.
  10. Children and adolescents under 16 years of age should be supervised by a legal guardian while on the premises. This guardian is responsible for the actions and damages caused by their charges.
  11. The pet owner bears direct responsibility for the actions and damages caused by the animal to the detriment of FIVE STARS Bed&Breakfast, its employees, and other Guests. The owner may be charged for any damages caused by the animal during its stay at the facility.
  12. FIVE STARS Bed&Breakfast reserves the right to refuse reservation fulfillment if fraudulent or improper conduct by the client is revealed, or in other circumstances where mistakes or errors in reservations are revealed, or reservations are found to be the result of software errors or mistakes.
  13. FIVE STARS Bed&Breakfast is not liable for inconveniences, breakdowns, and their consequences resulting from reasons beyond the facility’s control.
  14. FIVE STARS Bed&Breakfast is not liable for any damages, inconveniences, and lost benefits arising from delayed room availability.
  15. FIVE STARS Bed&Breakfast has no liabilities due to force majeure.
  16. FIVE STARS Bed&Breakfast is only responsible for items deposited in the Reception deposit. In other cases related to the loss or damage of items brought by Guests to the facility, the provisions of the Civil Code apply.
  17. The facility’s liability is also limited when the Guest improperly secures the room – the room should be checked for closure after each departure.
  18. FIVE STARS Bed&Breakfast reserves the right to refuse to accept items of high value, significant amounts of money exceeding the deposit storage capacity of the facility, and oversized items, the storage of which is difficult.
  19. Personal items left by the departing Guest in the rented room can be sent back upon the Guest’s order by a courier and after payment of the shipping costs by them. If the Guest does not collect the items left, the facility will store them for 1 (one) month. After this period, these items become the property of FIVE STARS Bed&Breakfast.

§8 Personal Data

  1. All personal data will be processed by FIVE STARS Bed&Breakfast in accordance with the current legal provisions regarding personal data, pursuant to Article 13(1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) – GDPR.

  3. Personal data is processed, used, and stored by the facility in accordance with the rules specified in the Personal Data Protection Act and the Privacy Policy, which can be found in the Privacy Policy section on the website or at the Reception of the FIVE STARS Bed&Breakfast.
  4. The guest consents to the storage and processing of their personal data necessary to perform the accommodation service in accordance with the principles set out in the Privacy Policy of the facility.
  5. Providing personal data by the guest is entirely voluntary but necessary to purchase the services of FIVE STARS Bed&Breakfast.
  6. The guest has the right to access the content of their data and to correct, change, and delete it at any time in accordance with the principles set out in the Privacy Policy of the facility.
  7. By using any services provided by FIVE STARS B&B, the guest accepts the rules contained in the Privacy Policy published on the website www.fivestarsbb.com.

§9 Final Provisions

  1. The applicable law for the Agreement and any potential disputes between the Parties is Polish law, and the official language is Polish.
  2. Any disputes between the Parties shall be resolved by the court having jurisdiction over the location of the FIVE STARS Bed&Breakfast.
  3. Matters not regulated in this Regulation shall be governed by the relevant provisions of the Civil Code and other applicable Polish laws.
  4. The facility reserves the right to make changes to this Regulation.
  5. All other matters are governed by the internal procedures of the FIVE STARS Bed&Breakfast.
