§1 General provisions

  1. The Regulations specify the rules for the provision of services, making a reservation for a stay at the FIVE STARS Bed&Breakfast, canceling a stay reservation, methods and deadlines for payment for a stay reservation, rules for accommodation at the FIVE STARS Bed&Breakfast facility, liability and rules for staying at the FIVE STARS Bed&Breakfast.
  2. By performing the activities specified in section 1 of this paragraph of the Regulations, the Guest confirms that he has previously read and accepts all the terms and conditions of the Regulations without any reservations.
  3. The Regulations constitute an Agreement concluded between the Guest and the FIVE STARS Bed&Breakfast at the time of making a reservation or paying the prepayment or the entire amount for the stay. The implementation of the Agreement takes place on the terms set out in the Regulations.
  4. For Agreements concluded off-premises, the provisions of Art. 38 point 12 of the Consumer Rights Act (Journal of Laws of 2014, item 827).
  5. The regulations apply to all persons staying at the FIVE STARS Bed&Breakfast facility.
  6. The regulations are available on the website of the FIVE STARS Bed&Breakfast at: and at the facility’s Reception.

§2 Reservation and cancellation conditions

  1. Reservations for a stay at the FIVE STARS Bed&Breakfast can be made: by phone, by e-mail, using the e-mail address provided on the FIVE STARS Bed&Breakfast website, through the reservation System available on the FIVE STARS Bed&Breakfast website, directly at the facility’s Reception, or via reservation Portals that cooperate with the FIVE STARS Bed&Breakfast.
  2. The Guest is solely responsible for the consequences resulting from providing incorrect data by the Guest during the booking process.
  3. You can make a reservation by phone by contacting the reception of the FIVE STARS Bed&Breakfast
    at phone: +48 881 339 339 and providing the necessary data and information necessary to create a reservation in the Reception System.
  4. Making a reservation via the Reservation System available at is possible after selecting the “Book” option and involves selecting a date, stay offer and completing the reservation form. The system will calculate the price for the stay in accordance with the applicable Price List. The reservation will be created after pressing the “Book” button, which will be available after accepting these Regulations.
  5. After making a reservation via the Reservation System, the Guest will receive its confirmation to the indicated e-mail address.
  6. After making a reservation via e-mail, the Guest receives a preliminary reservation confirmation to the indicated e-mail address, which contains the conditions for booking the stay and information necessary to make a prepayment.
  7. Reservations made by phone, via the Reservation System or by e-mail have the status of a pending reservation until the Guest makes the payment.
  8. The value of the amount paid may be equal to the cost of the entire stay, or less, as indicated by the Reservation System or the employee accepting the reservation. When booking for one night, the prepayment amount is 100% of the stay value.
  9. The amount paid towards the reservation, the value of which is less than the total cost of the stay, is treated as a prepayment.
  10. If the prepayment is not received in the property’s bank account within the time specified in the reservation or is received later, FIVE STARS Bed&Breakfast reserves the right to sell the stay to another person and cancel the reservation. Failure to pay the prepayment by the deadline will result in reservation cancellation.
  11. If the Guest cancels the stay at least 24 hours before the start of the hotel day of the booked arrival date, the prepayment will be returned to the account of the reserving Guest within 7 (seven) days from the date of cancellation of the reservation by the FIVE STARS Bed&Breakfast or in the form of a Voucher with a value equal to prepayment made. The Voucher may be redeemed at the FIVE STARS Bed&Breakfast after the Guest contacts the facility in order to agree on the date, room availability and other conditions of the stay, as well as the valuation of the stay according to the price list valid at that date.
  12. Changing the date of stay must be agreed with the FIVE STARS Bed&Breakfast at least 24 hours before the start of the hotel day and depends on the availability of places. Changing the date of your stay results in a new valuation of your stay.
  13. If the Guest does not show up at the facility on the day of arrival or the Guest fails to notify of cancellation or notification less than 24 hours before the start of the hotel day of the booked arrival, the prepayment will not be refunded.
  14. At the Guest’s request, FIVE STARS Bed&Breakfast will send confirmation of the Guest’s prepayment after the payment has been credited to the Facility’s account by the Bank.
  15. The guest is obliged to pay the costs of booking the stay no later than on the day of check-in.
  16. Prices of services include VAT at the rate applicable depending on the service provided.
  17. FIVE STARS Bed&Breakfast may collect a deposit from the Guest, which is a security deposit of PLN 500. The deposit must be paid in full before checking into the room. Failure to pay the required deposit will result in cancellation of the reservation, regardless of the source of the reservation. The deposit can be paid by transfer to the property’s account or in cash at the reception. The deposit is returned after the end of the stay within 7 (seven) days to the account from which it was paid or in cash if it was paid at the Reception. FIVE STARS Bed&Breakfast reserves the right to retain the deposit paid in whole or in part in the following cases:
    • a). in the event of a gross violation of the regulations applicable at the facility, in particular in the event of disturbing the peace at night or violating the ban on organizing events and social meetings at the facility,
    • b). violation of the smoking ban in the facility,
    • c). in the event of damage and destruction in the room or loss of its equipment,
    • d). if, as a result of the actions of the person renting the room, it will be necessary to temporarily suspend further rental of the room.
  18. The payment for the stay is non-refundable in the event of shortening the stay.
  19. The stay of animals on the premises must be previously reported and confirmed at the reception of the FIVE STARS Bed&Breakfast.
  20. Additional pet charges may apply at FIVE STARS Bed&Breakfast.

§3 Accommodation

  1. Accommodation is possible until 20:00 on the day of arrival. In case of later arrival, please inform the reception by 20:00.
  2. Early check-in is possible after agreeing room availability with the reception.
  3. The basis for accommodation is the presentation of a photo ID.
  4. When checking in, you may be required to complete and sign a registration card.
  5. FIVE STARS Bed&Breakfast reserves the right to refuse accommodation if the Guest:
    • a). does not have or does not want to show a photo ID,
    • b). refuses to fill out and sign the registration card,
    • c). refuses to pay for the stay or mandatory fees,
    • d). during the last stay, the guest grossly violated the facility’s regulations,
    • e). refers vulgarly to the facility’s employees,
    • f). when the Guest is significantly under the influence of alcohol or other intoxicants, does not comply with the norms of social coexistence, or becomes violent.
  6. The Guest does not acquire a claim for the availability of a specific Room in the facility.
  7. Upon check-in, the Guest receives an appropriately programmed entry card to the room and the entrance gate to the facility, or entry codes are sent to the Guest by e-mail or via SMS to the data indicated when booking the stay.
  8. At the Guest’s request, a room change is possible after agreeing with the Reception about the availability of rooms, but the payment for the stay is not reduced.
  9. Guests may stay at the FIVE STARS Bed&Breakfast from 7:00 a.m. to 10:00 p.m.
  10. It is prohibited to lend the room to third parties, even if the period for which the fee was paid has not expired. The room is rented to specific persons indicated in the stay reservation.
  11. At the Guest’s request, the facility may provide luggage storage service during Reception opening hours.

§4 Hotel stay

  1. The room is rented for hotel days.
  2. The hotel day is from 3:00 p.m. to 11:00 a.m.
  3. If the Guest wishes to extend the hotel day or stay, the Guest should inform the Reception Desk no later than 10:00 a.m. on the day on which the stay in the room expires.
  4. The possibility of extending the hotel day until 1 p.m. depends on room availability and is available for an additional fee.
  5. If the Guest does not leave the room by 11.00 and does not notify about the desire to extend the hotel day, it will be automatically extended for another day, at the current room price. If it is not possible to extend the hotel day, a fee of PLN 30/person will be charged for each additional hour of stay.
  6. If the Guest does not arrive at the FIVE STARS Bed&Breakfast by 11.00 on the check-out day, the facility reserves the right to enter the room and transfer the items to the depository.
  7. FIVE STARS Bed&Breakfast reserves the right to refuse to extend the stay if the Guest has not paid for the earlier stay.

§5 Rules of stay

  1. Night curfew applies from 10 p.m. to 7 a.m. Only registered guests can stay in the room during this time. FIVE STARS Bed&Breakfast may refuse to provide further services without refund of the stay if this policy is violated.
  2. The reception is open from 8:00 a.m. to 8:00 p.m., any inconvenience related to your stay should be reported immediately to the receptionists to enable FIVE STARS Bed&Breakfast employees to take the necessary actions as quickly as possible and improve the standard of services provided.
  3. Room cleaning is performed at the guest’s request.
  4. SMOKING is strictly prohibited in the rooms and on the premises . For violating this rule, a fine of PLN 500 will be imposed, including cleaning and long-term airing of the room, as well as additional washing and cleaning of the equipment.
  5. If necessary, FIVE STARS Bed&Breakfast may perform necessary repairs to equipment in the room during the guest’s absence.
  6. Children must be under constant care and supervision of adults throughout their stay at the facility.
  7. Minors up to 13 years of age may use the elevator in the facility only under the supervision of adults.
  8. At the guest’s request and subject to availability, it is possible to place a cot for small children in the room free of charge (applies to children up to 3 years of age).
  9. For the sake of safety and proper security of the room, each time the guest leaves the room he is obliged to close the windows, turn off the TV and lights, turn off the taps in the bathroom and close the door. If access codes are assigned to the room and facility for the duration of the stay, the Guest is obliged to protect them and not share them with other people. In the event of loss or loss of the room and entrance door key card, please report this fact to the reception immediately.
  10. For fire safety reasons, it is prohibited to use electric heaters, irons, etc. in the room.
  11. Hazardous materials cannot be stored in the room, including: weapons, ammunition, flammable, explosive or irritating materials.
  12. Parties and social gatherings are strictly prohibited in the rooms. In the event of intervention by the Police, City Guard or a company protecting the facility, FIVE STARS Bed&Breakfast may impose a fine of PLN 1,000 on the Guest.
  13. Guests are prohibited from taking items belonging to the FIVE STARS Bed&Breakfast outside the facility. It is possible to purchase some items of equipment (e.g. towels, decorative pillows). Information can be obtained at the reception.
  14. If animals stay on the premises of the FIVE STARS Bed&Breakfast, the owner is obliged to keep the animal in such a way that it does not pose a threat to the surroundings and to clean up all waste related to its stay.
  15. Pets must be kept on a leash in public areas.

§6 Responsibility

  1. The guest is liable for any damage to the FIVE STARS Bed&Breakfast caused by his fault as well as the fault of persons accompanying or visiting him. Damage means both destruction/damage to room furnishings and their loss.
  2. In the event of damage or destruction of room equipment or other technical devices on the premises, the Guest is obliged to report the incident to the FIVE STARS Bed&Breakfast Reception.
  3. The guest bears direct financial liability in the event of damage, damage or destruction in the room or loss of elements of its equipment, in particular:
    • a). furniture, lighting and other decorative elements in the room;
    • b). sanitary fittings, bathroom equipment elements;
    • c). damage to towels, bedding, curtains and other textiles in the room resulting from tearing, cutting, using cosmetics, removing make-up, cleaning shoes, etc.;
    • d). replacing light bulbs, overvoltage using non-certified electrical devices and technical equipment of the facility.
  4. The equipment price list and the damage removal price list are annexes to the Regulations and are available at the reception desk of the FIVE STARS Bed&Breakfast. Regardless of the price list, FIVE STARS Bed&Breakfast reserves the right to individually and separately assess the damage depending on the work necessary to remove the damage. The valuation of loss of equipment or damage and the costs of their removal will be made by the FIVE STARS Bed&Breakfast after the end of the Guest’s stay at the facility, based on the costs of purchasing materials, devices and the costs of repair or replacement services.
  5. The guest bears direct financial liability as in point 1 in the event of losing the room key card or making it available to unregistered persons, resulting in damage or theft by third parties.
  6. The guest bears full and direct financial responsibility for losing the key or entry card to the room and building or parking card. Fees for a lost key or magnetic card are specified in the damage removal price list, which is an annex to these regulations.
  7. In the event of damage or destruction caused by the Guest’s fault, FIVE STARS Bed&Breakfast reserves the right to charge the Guest’s credit card for the damage caused after his departure.
  8. In the event of violation of the terms of the regulations, FIVE STARS Bed&Breakfast reserves the right to immediately discontinue the provision of services. A person violating the regulations is obliged to comply with the demands of FIVE STARS Bed&Breakfast, pay the costs of accommodation and pay for any damage caused.
  9. Children and adolescents under 16 years of age should stay on the premises under the supervision of a legal guardian. This guardian is responsible for the acts and damages caused by the children under their care.
  10. The owner of the animal is directly liable for any acts or damage caused by the animal to the detriment of the FIVE STARS Bed&Breakfast, employees and other guests. The owner may be charged for any damage caused by the animal during its stay at the property.
  11. FIVE STARS Bed&Breakfast reserves the right to refuse reservations in the event of a customer’s fraudulent or inappropriate conduct, or in other circumstances where errors or errors in reservations are discovered, or the reservations are found to be the result of an error or software error.
  12. FIVE STARS Bed&Breakfast is not responsible for any inconvenience, failures or their consequences that occur for reasons beyond the property’s control.
  13. FIVE STARS Bed&Breakfast is not liable for any damage, inconvenience or lost profits resulting from the delayed availability of the room.
  14. FIVE STARS Bed&Breakfast shall not be liable for any obligations resulting from force majeure.
  15. FIVE STARS Bed&Breakfast is only responsible for items deposited at the Reception. In other cases related to the loss or damage of items brought by guests to the Facility, the provisions of the Civil Code apply.
  16. FIVE STARS Bed&Breakfast reserves the right to refuse to accept high-value items, large amounts of money that exceed the facility’s storage capacity, or large items that are difficult to deposit.
  17. Personal items left by the departing Guest in the rented room may be sent back after the Guest orders a courier and pays the shipping costs. If the Guest does not collect the items left behind, the facility will store them for 1 (one) month. After this date, these items will be forfeited to FIVE STARS Bed&Breakfast.

§7 Personal data (GDPR)

  1. All personal data will be processed by the FIVE STARS Bed&Breakfast  in accordance with current legal provisions regarding personal data, in accordance with Art. 13 section 1 and section 2 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation ) – the so-called “GDPR”.

  3. The facility processes your personal data:
    • a). provided by the person making the reservation, necessary to make and process the reservation: name, surname, e-mail address, telephone number;
    • b). provided upon check-in, including in accordance with paragraph 3, points 3 and 4 of these Regulations; Guests are asked to provide necessary personal information; data of a Guest who concludes a Stay Agreement at the facility on his/her own behalf, necessary for its conclusion and fulfillment of the facility’s obligations, including subsequent identification of such Guest and making appropriate settlements, include: name and surname, address of residence, type and number of the identity document, data regarding payments, data necessary to issue a VAT invoice (when the Guest asks for it to be issued); in order to fulfill statutory obligations, including statistical ones, Guests’ data regarding their country of residence may also be collected;
    • c). in connection with the implementation of the Agreement and the use of the services of the
      FIVE STARS Bed&Breakfast by Guests and their settlement, as well as to facilitate their implementation or ensure their highest quality; such data may include: the Guest’s e-mail address, contact telephone number, information regarding the services provided and facilities used by the Guest, data necessary to provide them or make settlements in this regard, data regarding comments and complaints and their handling, data regarding items Guests who will remain at the facility after the Guest has finished using the services;
    • d). related to ensuring order, safety and comfort of stay, including the image of people staying on the premises of the FIVE STARS Bed&Breakfast, recorded as part of standard video monitoring, as well as a list of people referred to in paragraph 3 point 5 of these Regulations.
  4. Providing personal data by the Guest is a condition for concluding and implementing the Agreement. If you refuse to provide this data, the contract will not be concluded or performed, and the services related to such refusal will not be provided. Failure to provide identifying data by persons making a reservation will prevent it from being submitted and confirmed.
  5. Guests’ personal data are processed for the following purposes and based on legal bases:
    • a). making a reservation, check-in and concluding a contract and identifying the Guest as a party to the contract for the provision of services related to the stay at the facility – processing is necessary to take action at the request of the data subject before concluding the contract (Article 6(1)(b) of the GDPR );
    • b). performance of the contract, including all services provided to guests in connection with its implementation and related settlements – processing is necessary for the performance of the contract to which the data subject is a party (Article 6(1)(b) of the GDPR);
    • c). ensuring the highest quality of services for the facility’s guests, including actions regarding submitted comments and complaints – processing is necessary for the purposes of the legitimate interests pursued by the FIVE STARS Bed&Breakfast regarding striving to provide the highest quality of services (Article 6(1)(f) GDPR);
    • d). ensuring order, safety of persons and property on the premises, as well as the comfort of the Guests’ stay – processing is necessary for the purposes of the legitimate interests pursued by the FIVE STARS Bed&Breakfast regarding the need to ensure order, safety on the premises and the comfort of the Guests’ stay (Article .6(1)(f) GDPR);
    • e). ensuring compliance of activities with legal provisions, including documenting the provision of services for tax purposes, fulfilling statistical obligations, maintaining accounting and bookkeeping standards – processing is necessary to fulfill the legal obligation imposed on the facility (Article 6(1)(c) of the GDPR);
    • f). determining, pursuing and defending claims – processing is necessary for the purposes of legally justified interests pursued by the FIVE STARS Bed&Breakfast related to the determination, pursuit and defense of claims related to the operation of the facility, operation of the video monitoring system (Article 6(1)(f) GDPR).
  6. We obtain Guests’ personal data directly from Guests or they come from the resources of the FIVE STARS Bed&Breakfast (e.g. video monitoring). Personal data of Guests may be obtained by the FIVE STARS Bed&Breakfast facility also from external operators and organizers cooperating with the facility in the scope related to making reservations for a stay at the FIVE STARS Bed&Breakfast  or concluding contracts for hotel services.
  7. Only authorized employees of FIVE STARS Bed&Breakfast and entities cooperating with the facility with which appropriate contracts have been concluded have direct access to Guests’ personal data. This applies to companies that provide services to the facility or guests, e.g. companies providing IT support services and providing software or IT services, companies providing accounting, legal or auditing services, marketing services, companies providing postal and courier services as well as transport and taxi companies to ensure Guest of the ordered transport.
  8. The person whose data is processed has the right to request access to his or her personal data, rectification, deletion or limitation of processing, as well as the right to transfer this data.
  9. The rights indicated in point 8 can be completed by sending correspondence to the facility’s address: 50-079 Wrocław, ul. Ruska 35, by e-mail: The Administrator will exercise the indicated rights if there are no circumstances authorizing the Administrator to process them, of which the data subject will be informed.
  10. Guests have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.
  11. Personal data will be stored:
    • a). in connection with the performed contract, i.e. provision of hotel services – for the duration of the contract and stored until the expiry of the obligation to store data resulting from legal provisions, in particular the obligation to store accounting documents related to the contract, including for the period of expiry of claims, i.e. the period necessary to secure and pursuing claims under contracts;
    • b). in connection with the video monitoring system up to 20 days.
  12. Guests’ personal data are not subject to profiling or similar decision-making, which is based solely on automated processing.

§8 Final provisions

  1. The law applicable to the Agreement and any possible disputes between the Parties is Polish law, and the appropriate language is Polish.
  2. Any disputes between the Parties will be resolved by the court competent for the seat of the FIVE STARS Bed&Breakfast.
  3. In matters not regulated in these Regulations, the relevant provisions of the Civil Code and other relevant provisions of Polish law shall apply.
  4. The facility reserves the right to make changes to these Regulations.
  5. All other matters are regulated by the internal procedures of the FIVE STARS Bed&Breakfast.
